LAWS OF THE
PLATFORM

I. The Platform & The Private Domain

DinkSpy is a private user platform; all activity within the platform — including submission of scouting reports, viewing reports, and use of any feature — occurs within the private domain only; nothing offered or transacted within the platform constitutes a public marketplace, registry, or official record;

i, as the man who created and stewards the platform, speak to all users as men and women only; the platform exists to allow the private sharing of observation, strategy, and experience among those of good will;

the platform, its website, its application, its name, its data, its structure, and all creative work produced by or for it are the property of i; all who make use of any of them do so in the private and take full responsibility for their use; no user may use the DinkSpy name, marks, or data for any public or commercial purpose without the prior written consent of the man, Kyle Henson;

II. Access & User Status

access is open to adults of lawful age only; a man or woman becomes a user when they create an account and agree to the User Agreement;

access may be offered in free or paid (Pro) form; Pro access provides additional features, insights, or data as determined by the platform;

any fees for Pro access are published at dinkspy.com; fees are non-refundable; a user may choose not to renew at the end of any billing period;

we reserve the right to refuse, suspend, or terminate access at our sole discretion, whether or not a fee has been paid;

a user may cancel their access at any time by writing to us at hello@dinkspy.com; upon cancellation, access to the platform will end;

III. The Data & Scouting Reports

all scouting reports, ratings, notes, and data within DinkSpy are private; they are accessible only to active users and are not made available to the public;

all content submitted to the platform — including scouting reports and associated data — becomes the property of DinkSpy and the man, Kyle Henson;

reports are submitted anonymously; they represent the opinions and observations of individual users only; they are not verified statements of fact;

users are responsible for the content they submit; a user agrees that their submissions are made in good faith and based on their own experience;

users agree not to copy, reproduce, distribute, or sell any data or content obtained through the platform outside of DinkSpy without written consent;

IV. Use of Information

all information within DinkSpy is provided for private use only;

users acknowledge that scouting reports may be incomplete, inaccurate, biased, or outdated;

users take full responsibility for how they interpret, rely upon, or act on any information obtained through the platform;

the platform does not guarantee outcomes, performance, or results based on the use of any information provided;

V. Personal Responsibility

all who use DinkSpy do so as a man or woman only, in their own right; each takes full responsibility for their conduct, decisions, and actions;

users accept that competitive sport involves judgment, opinion, and interpretation; any conclusions drawn from the platform are their own;

each user agrees not to hold the platform or the man Kyle Henson responsible for any loss, dispute, or consequence arising from their use of the platform;

each user agrees to indemnify and hold harmless the platform and the man Kyle Henson from any claim arising from their use of the platform or content submitted;

VI. User Conduct

each user agrees to treat every other man or woman with respect;

users shall not submit content that is false, malicious, deceptive, or intended to harm another;

users shall not use the platform to harass, target, or intimidate any individual;

users shall not upload or share sensitive personal information about any man or woman;

users shall not attempt to manipulate, game, or corrupt the integrity of scouting reports or data;

users shall not scrape, copy, or extract platform data for external use;

a user who acts in a manner that is abusive, deceptive, or harmful, and does not make remedy to the satisfaction of the one wronged, will have their access terminated, without refund;

VII. The Scouting System

DinkSpy provides a structured system for users to submit observations, ratings, and strategic insights regarding pickleball play;

scouting reports are expressions of individual experience and are not endorsements, guarantees, or official evaluations;

aggregated insights, summaries, or patterns generated by the platform are derived from user submissions and are not representations of objective fact;

the platform may modify, aggregate, prioritize, or remove reports and data at its sole discretion;

VIII. Privacy & Information

information provided to the platform is held in the private;

scouting reports are submitted anonymously and displayed without identifying the submitting user;

the platform may store, analyze, and use data to improve its functionality and insights;

the platform will not knowingly sell personal user information to outside parties;

a user may request access to or deletion of their personal data by writing to hello@dinkspy.com;

the platform may use cookies and similar technologies; by using the platform, users agree to their use;

IX. Changes to the Laws

we reserve the right to change these laws whenever we feel it is needed;

continued use of the platform following any change signifies acceptance of the updated laws;

these laws apply to all activity offered by or through DinkSpy, whether on the website, application, or any related system;
