AGREEMENT

a private user platform; for those of mankind only

DinkSpy ("the platform") is a private user platform, for those of mankind only, to observe, share, and access insights regarding pickleball play — connecting men and women of good will through the private sharing of scouting reports, observations, and strategic insights, in a manner that honours personal responsibility, the integrity of the game, and the sanctity of private agreement;

the platform is created and stewarded by i: a man; Kyle Henson; access is offered in both a free form and a paid subscription form (Pro), at the rates published at dinkspy.com; all activities through or within the platform — including submission of scouting reports, access to reports, and any correspondence — occur within the private domain only;

user access commences when you make the agreement below, and ends whenever you or i (or a man or woman acting on my behalf) wish to end the agreement for any reason, with or without notice;

when you create an account, access the platform, submit a report, or use any feature of DinkSpy, you confirm your acceptance of this User Agreement;

the agreement is written and stated for everyone's benefit — to maintain our relating with each other in the private, as man and woman, the way God made it; and to remove any presumptions that any other soul or person may seek to apply to bind us to a lesser form;

Affirmation

i enter into this agreement of my own free will; i choose to establish this agreement between i, and the man, Kyle Henson;

i attest that i am an adult of lawful age in my jurisdiction, and that i am entering this agreement in my own right and private capacity as a man or woman only;

i agree to be responsible for my own actions, for how i use the platform, and for the consequences of any information i submit, access, or rely upon;

i attest that my actions on this and any subsequent use of the platform — including submission of scouting reports, viewing reports, or engaging with any content — are by i, in my own right and private capacity as a man/woman only;

Nature of the Platform

i understand that DinkSpy is a private platform for the sharing of user-generated scouting reports and opinions regarding pickleball players;

i understand and agree that all scouting reports, ratings, observations, and strategic insights are subjective opinions only, submitted by other users, and are not verified statements of fact;

i understand that reports are submitted anonymously and may be incomplete, inaccurate, biased, or outdated;

i agree that i use any information obtained through the platform at my own risk and discretion;

Content Ownership

i understand and agree that any content i submit — including scouting reports, ratings, notes, and all associated data — becomes the sole property of DinkSpy and the man, Kyle Henson;

i waive any claim of ownership, compensation, or control over such submitted content;

i agree that DinkSpy may use, modify, display, aggregate, distribute, or remove such content at its sole discretion;

i agree not to copy, reproduce, distribute, or sell any content obtained through the platform outside of its intended use without express written consent from the man, Kyle Henson;

Conduct

i agree to act according to law, and to conduct myself with respect toward all other users of the platform;

i agree that i will not submit false, malicious, defamatory, or intentionally misleading reports;

i agree that i will not use the platform to harass, target, or harm any man or woman;

i agree that i will not upload or share sensitive personal information about any individual;

i understand that if i act in a manner that is abusive, deceptive, irresponsible, or harmful, or fail to make remedy to the satisfaction of the one wronged, my access to the platform may be terminated immediately, without refund;

Liability

i agree that DinkSpy, and the man Kyle Henson who created and stewards it, are not responsible for:

the accuracy or reliability of any scouting report or content
the actions, conduct, or statements of any other user
any decisions i make based on information obtained through the platform

i agree not to hold DinkSpy or its creator liable for any claim, loss, dispute, or damage arising from my use of the platform or my interaction with its content;

i agree that any claims of wrong arising under this agreement shall be governed only by law, and may be brought only in a court of law by and between those of mankind, where earnest attempts for peaceful remedy have failed;

Access & Termination

i understand that access to DinkSpy may be granted in free or paid (Pro) form;

i understand that any fees paid for access are in exchange for access to the platform and its features, and not for any guaranteed outcome or result;

i agree that i, or the man Kyle Henson (or a man or woman acting on his behalf), may terminate my access to the platform at any time, for any reason or no reason, with or without notice;

i understand and agree that termination may occur without refund of any fees paid;

i understand that DinkSpy reserves the right to remove, modify, or restrict access to any content at any time;

Private Nature

i agree that all use of DinkSpy occurs within the private domain only;

i agree not to treat the platform, its contents, or its users as part of any public system, registry, or regulated space;

i agree that my participation is voluntary, private, and governed solely by this agreement between i and the man, Kyle Henson;

Autograph

by using DinkSpy — creating an account, accessing the platform, or submitting any content — you affirm that you have read and agree to this User Agreement in full, of your own free will, in your private capacity as a man or woman;
